1. Acceptance of Terms
By accessing or using our website (kryptasys.in), our compliance platform (DPDP Shield), or any security services provided by Kryptasys ("Kryptasys", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms") and all applicable local, national, and international laws.
If you are using these services on behalf of an enterprise or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree with any of these terms, you are prohibited from using or accessing our tools and platforms.
2. Use License & Scope
Kryptasys grants you a limited, non-exclusive, non-transferable, revocable license to access and use DPDP Shield as a hosted web service for the purpose of assessing and managing your organisation's DPDPA compliance posture.
Free tier access is subject to usage limits defined by Kryptasys. Commercial use beyond free tier limits requires an active paid subscription.
You may not:
- Attempt to reverse-engineer, decompile, or extract proprietary logic from Kryptasys platforms.
- Remove copyright or proprietary markings from any Kryptasys materials.
- Resell, sublicense, or provide access to Kryptasys products to unauthorised third parties without prior written consent.
- Use automated scripts or bots to access or scrape Kryptasys platforms.
3. User Responsibilities
As a user of our software and platforms, you represent and warrant that:
- Lawful Implementation: You will implement our tools, local containers, and assessment engines in strict compliance with the laws of the Union of India, specifically including the DPDPA 2023 and the Information Technology Act, 2000.
- CTF Platform Ethics: Users participating in or hosting cyber drills on our CTF platform must act ethically. You will not attempt to exploit, crash, or manipulate the hosting infrastructure beyond the defined scope of the training exercise.
- Account Safeguards: You are responsible for keeping all access credentials, license keys, and API tokens issued to you secure.
4. Advisory & Disclaimers
No Formal Legal Counsel Disclaimer
Compliance scores, diagnostic outputs, and policy recommendations generated by DPDP Shield do not constitute formal legal counsel. While our 58-point engine is aligned directly with India's DPDPA 2023 clauses, compliance is a dynamic operational process. You should consult a qualified legal professional or Data Protection Officer (DPO) to verify complete regulatory alignment.
The software is provided "as is" and "as available". Kryptasys makes no warranties, expressed or implied, regarding the continuous availability of third-party CDNs, nor does it guarantee that the software will be completely free from vulnerabilities. We prioritize security, but you implement our tools at your own discretion and risk.
5. Intellectual Property
All intellectual property rights associated with our website, software, systems, and tools (including but not limited to the codebase of DPDP Shield, internal SOC technologies like IDXSOC, forensic automation platforms like LEAP, visual brand assets, and content) are the exclusive property of Kryptasys or its licensors.
Nothing in these Terms transfers any intellectual property rights to you, except for the limited use licenses explicitly granted herein.
6. Limitations of Liability
To the maximum extent permitted by applicable Indian law, Kryptasys and its officers, directors, or employees shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:
- The use or inability to use our local scanners, compliance engines, or training platforms.
- Any regulatory fines, operational disruptions, or data breaches suffered by your organization.
- Unauthorized access to or alteration of your local compliance configurations or data logs.
Our total cumulative liability under these Terms or related to our products shall not exceed the amount paid by you to Kryptasys for the specific product or service during the twelve (12) months preceding the claim.
7. Governing Law
These Terms, your use of our platforms, and any disputes arising from them shall be governed by and construed in accordance with the laws of the Union of India, without regard to conflict of law principles.
Any legal action, suit, or proceeding arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi NCR, India.
8. Changes to Terms
We reserve the right to revise or update these Terms at any time without prior notice. The "Last Updated" date at the top of this page will indicate when changes were made. By continuing to access or use our platforms after revisions become effective, you agree to be bound by the updated terms.
